2. Scope of Application
These Terms apply to all visitors, users, and customers of Zacharias Gallery, whether purchases are made online or directly at the gallery.
If you do not agree with these Terms, you must not use our website or purchase our products.
3. Website Use
By using our website, you confirm that:
- You are at least 18 years old or have legal parental/guardian consent.
- You will not use the website for unlawful purposes.
- You will not attempt to interfere with the website’s security or functionality.
We reserve the right to suspend or terminate access if misuse is detected.
4. Products and Availability
Zacharias Gallery sells original artworks, art prints, and frames.
Original artworks are unique unless otherwise stated. Prints and frames may have slight variations in tone, texture, or finish due to display screens and production processes.
All products are subject to availability. We reserve the right to withdraw or modify products without prior notice.
5. Pricing and Payment
All prices are listed in Euro (€).
Prices may be updated at any time without notice; however, confirmed orders will not be affected by price changes.
Full payment must be received before dispatch or collection. Payment methods accepted will be specified at checkout or agreed upon at the gallery.
If a pricing error occurs due to a technical or human mistake, we reserve the right to cancel the order and refund any amount paid.
6. Orders and Acceptance
An order is considered accepted only when confirmation has been issued by Zacharias Gallery.
We reserve the right to refuse or cancel any order if:
- The product is unavailable
- Payment is not authorized
- There is a pricing or description error
- Fraud or suspicious activity is suspected
If an order is cancelled, any paid amount will be refunded.
7. Shipping and Collection
Delivery options:
- Pick up from ACS: €10
- Pick up from Gallery: Free
Delivery timelines are estimates and may vary. We are not responsible for delays caused by third-party courier services.
Risk of loss or damage transfers to the customer upon delivery to the courier or upon collection from the gallery.
Customers collecting from the gallery must provide order confirmation and valid identification.
8. Right of Withdrawal (EU Consumer Rights)
For online purchases within the European Union, consumers may have the right to withdraw from the purchase within 14 days of receiving the goods, without providing a reason, except where exemptions apply.
The right of withdrawal does not apply to:
- Customized or commissioned artworks
- Personalized frames
- Items damaged after delivery
Returned items must be unused, in original condition, and securely packaged. Return shipping costs are the responsibility of the customer unless the item is faulty.
Refunds will be processed after inspection of the returned item.
9. Damaged or Defective Items
If a product arrives damaged, you must notify us within 48 hours of delivery and provide photographic evidence.
After verification, we may offer replacement, repair, or refund at our discretion
10. Intellectual Property
All artworks, images, branding, logos, and website content are protected by copyright and intellectual property laws.
Purchasing an artwork does not transfer copyright ownership unless explicitly agreed in writing.
Reproduction, resale of prints, commercial use, or distribution without written permission is strictly prohibited.
11. Limitation of Liability
To the maximum extent permitted by law, Zacharias Gallery shall not be liable for:
- Indirect or consequential losses
- Loss of profits or business opportunities
- Delays caused by third-party service providers
Our total liability shall not exceed the purchase price of the product concerned.
12. Force Majeure
We shall not be held responsible for failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, transport disruptions, governmental actions, or technical failures.
13. Privacy
Personal information provided by customers will be used solely for order processing, communication, and legal compliance.
We do not sell or rent customer data to third parties. Information may be shared only with payment providers or courier services where necessary.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms constitute the entire agreement between Zacharias Gallery and the customer regarding purchases and website use.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Cyprus.
Any disputes arising from transactions or website use shall be subject to the exclusive jurisdiction of the courts of Cyprus.
